DECISION OF THE DIRECTOR GENERAL OF DRUG AND FOOD CONTROL ON SPECIAL SIGN FOR FOOD COLOURING AGENTS

Article 1

Meant in this Decision as:

Article 2

(1) On the package or outer wrap of food colouring agents, must be affixed clearly with special sign for food colouring agents;

(2) In addition to the special sign as contemplated in paragraph (1) in accordance with the Regulation of the Minister of Health RI No. 79/Menkes/Per/III/78 on Label and Advertisement of Foods and Regulation of the Minister of Health RI No. 722/Menkes/Per/IX/88 on Food Additives, on the package or outer wrap of food colouring agents must be written:

(3) Special Sign is not necessarily affixed on the package, if the colouring agent is for retail sale with package that is furnished with outer wrap.

Article 3

(1) Special Sign for food colouring agents is a circle with black edge line with letter M touching the edge line, as follows:

(2) Special Sign for food colouring agents as contemplated in paragraph (1) must be placed in such a way so that clearly readable and easy to identify.

(3) Size of the circle of special sign as contemplated in paragraph (1) is adjusted to the size and design of relevant label and outer wrap, with proportional circle diameter, edge line thickness and letter M thickness are, respectively at least one cm, one mm and one.

(4) Any departure from provisions as contemplated in paragraph (3) must obtain special consent of the Director General of Drug and Food Control cq. the Head of Directorate of Drug and Food Control.

Article 4

Example marking of food colouring agent that complies with provisions as contemplated in articles 2 and 3 must be sent immediately to the Directorate General of Drug and Food Control cq. the Head of Directorate of Drug and Food Control.

Article 5

(1) Food colouring agent whose approval is issued after issuance of this Decision must comply with provisions as contemplated in articles 2 and 3.

(2) Food colouring agents whose approval is issued before issuance of this Decision, its products hall have complied with the provisions in articles 2 and 3 not later than one year after issuance of this Decision.

(3) At the latest two years after issuance of this Decision, all food colouring agents in circulation must comply with provisions as contemplated in articles 2 and 3.

(4) Special sign for imported food colouring agents can take the form of sticker that is placed on the etiquette and on the outer wrap, for maximally 2 years after issuance of this Decision.

Article 6

Violation of any provisions in this Decision may subject to administrative penalty on the relevant manufacturer/importer and seizure of relevant food colouring agents in circulation.

Article 7

This Decision shall come to effective as of the date of stipulation.
